About Florida Community Associations

Put simply, community associations are miniature governments that are set up to protect the values of the members’ homes and to maintain any commonly property (prophttp://hoa-florida.com/wp-admin/admin.php?page=wpseo_xmlerty which the members own jointly). Homeowners associations (HOAs), condominium associations, and common-interest developments all fall into the category of community associations. Associations are incorporated (like a business), typically as not-for-profit entities. Its members are the dues-paying homeowners who live in the community. Each year, these members elect a Board of Directors from within the community to manage the association. Board members have a responsibility to uphold the community’s governing documents and to act in the best interests of the association at all times.

The “constitution” of the association is a set of documents called the Covenants, Conditions and Restrictions (CC&R’s), also known as the declaration. In addition to the CC&R’s, the Bylaws and the Rules and Regulations further regulate and interpret the rules of the community. During this month, one out of every 302 home in Florida was in the foreclosure process, which is almost three times the United States average. Another recently enacted law is HB 7119. This law helps Florida community associations by fixing a loophole in the statutes pertaining to foreclosure. Before HB 7119 was enacted, many associations were hindered from collecting past-owed dues a foreclosed home was re-sold.
